Terms & Conditions

These terms and conditions apply to the Simple Trivia app for mobile devices (the "Application"), made by Wayyy Out! Games (the "Service Provider").

By downloading, accessing or using the Application, you agree to these Terms and Conditions. Please read them carefully. How the Application handles your information is explained in the Privacy Policy.

License to use the Application

The Service Provider grants you a limited, personal, non-exclusive, non-transferable and revocable license to use the Application for your own non-commercial use.

You may not copy or modify the Application, any part of it, or its trademarks. You may not attempt to extract the Application's source code, reverse engineer or decompile it, translate it, or make derivative versions, except where the law allows this.

The Application, including its name, logo, artwork and all related intellectual property, belongs to the Service Provider, except as described in "Questions and artwork" below.

Your account

The Application creates a guest account for you automatically, and you may link it to Google. You are responsible for activity on your account. If you do not link your account to Google, you will lose it, and your progress, if you sign out, uninstall the Application, clear its data or change devices.

You can delete your account at any time from the Profile screen in the Application.

Usernames and avatars

Usernames are generated by the Application, and you can swap yours for another generated one a limited number of times a day. Avatars are built from the Application's own illustrations. If a generated username turns out to be offensive, report it and the Service Provider will change it.

Chat

Live games include a chat for the players in that game. When you use it, you agree not to post anything offensive, hateful, sexual, threatening or harassing, not to spam, and not to share your own or anyone else's personal information, such as a phone number or address. Chat is checked for offensive words, but the check is not perfect. The Service Provider may remove messages and suspend or delete accounts that break these rules.

Fair play

To keep the game fair and fun for everyone, you agree not to:

• •Cheat, including by using bots, scripts, modified versions of the Application or other tools that answer for you or give you an unfair advantage
• •Exploit bugs, or interfere with or disrupt the Application, its servers or other players
• •Use more than one account to manipulate leaderboards, duels or rewards

The Service Provider may remove scores, reset progress, or suspend or delete accounts that break these rules.

Leaderboards, daily challenges and duels

Leaderboards, daily challenges, live games and duels are provided for fun. The Service Provider may change how they work, reset them, or correct results at any time, for example to fix errors or remove cheating.

Points, levels and badges

Points, experience, levels, streaks, streak freezes, badges and avatar items are part of the game. They have no monetary value, cannot be bought, sold or exchanged for money, and may be adjusted or reset. They are lost if your account is deleted.

Questions and artwork

Questions come from The Trivia API. The Service Provider works to keep them accurate but does not guarantee that every question or answer is correct, complete or up to date. If you spot a mistake, please let the Service Provider know.

Notifications

If you allow notifications, the Application may send you messages about the game, such as duel turns and streak reminders. You can turn them off at any time in your device settings.

Free to use

The Application is currently free to use. If the Service Provider ever charges for the Application or any part of it, it will make clear exactly what you are paying for before you pay anything.

Availability and updates

The Application is currently available for Android through Google Play. The Service Provider may update the Application, add, change or remove features, or change the devices it supports. You may need to install updates to keep using the Application, and it needs an internet connection to play.

The Service Provider does not promise that the Application will always be available, uninterrupted or compatible with your device, and may stop offering it at any time.

Disclaimer

The Application is provided "as is" and "as available". To the extent permitted by law, the Service Provider makes no warranties that it will be uninterrupted, error-free or suitable for any particular purpose.

Limitation of liability

To the extent permitted by law, the Service Provider is not liable for any indirect, incidental or consequential loss arising from your use of, or inability to use, the Application, including loss of game progress. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be excluded.

Termination

You can stop using the Application at any time, and you can delete your account from the Profile screen. The Service Provider may suspend or end your access to the Application if you break these Terms. When your access ends, you must stop using the Application.

Changes to These Terms and Conditions

The Service Provider may update these Terms and Conditions from time to time. Updates will be posted on this page with a new effective date. If you keep using the Application after an update, you accept the updated Terms.
